A federal judge has ruled that the memo restricting DACA from this past summer is invalid. The memo restricted current DACA recipients to one year renewals and stated that no first-time applications would be accepted.
The judge found that the memo was invalid because the acting Homeland Security secretary who issued the memo was not properly appointed.
At this point we aren’t sure when new DACA applications will be accepted, or when USCIS will start issuing 2 year renewals again. We’re keeping an eye on these developments and will update you if first-time applications again become available.
